Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Gifthycards website and service (“Gifthycards”, “we”, “our”, or “us”), an online marketplace through which you can purchase digital gift cards and pay using cryptocurrency. By creating an account, browsing the catalog, placing an order, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not use the Service.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service before they take effect. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those changes.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and place an order. By creating an account you confirm that you meet this requirement and that the information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We do not require identity verification (KYC) to buy with crypto; however, where required by law or to prevent fraud we may request additional verification.

All prices are displayed in the store currency (USD) at the time of purchase and include applicable fees, unless stated otherwise. We reserve the right to change prices at any time; changes do not affect orders already placed.

Gift cards are sold as digital codes. By placing an order you agree to pay the total shown at checkout in the cryptocurrency you select. An order is only confirmed once the corresponding payment has been received and confirmed on the relevant blockchain.

Payments are processed by Paymento, a non-custodial cryptocurrency payment gateway, and are subject to Paymento's own terms and privacy practices. When you check out you will be directed to Paymento's interface, where the order total is converted to the cryptocurrency you choose at a live rate. Neither we nor Paymento take custody of your cryptocurrency; funds are transferred directly from your wallet to the merchant's designated wallet.

We do not require identity verification (KYC) or identity documents to buy gift cards with cryptocurrency, and we never collect your wallet keys or seed phrases.

Cryptocurrency transactions are generally irreversible. We do not control blockchains and are not liable for network delays, failed confirmations, or errors in payment amounts that result from your actions. Payment quotes are time-limited and may be refreshed.

Once a payment is confirmed, gift-card codes are delivered automatically to the order page in your account. You are responsible for safeguarding delivered codes; treat them like cash. Redemption of a code is subject to the terms of the issuer, which we do not control. Gift-card trademarks belong to their respective owners and are used only to describe the products available.

Delivery is automatic and usually instant once payment is confirmed, and Gifthycards does not expire purchased codes. Exact validity is determined by the issuer of the card.

Orders that are still awaiting payment may expire or be canceled. A paid order that has been delivered is generally non-refundable because gift-card codes are digital and delivered immediately.

If you receive an invalid code, or an order is not fulfilled correctly, contact us within 14 days of purchase and we will investigate and, where appropriate, replace the code or issue a refund. Nothing in these Terms limits any mandatory rights you may have under the consumer laws of your country of residence. If you initiate a chargeback or dispute without justification, we may suspend your account pending review.

You agree not to: use the Service for any unlawful purpose; misrepresent your identity; attempt to access another user's account or our systems without authorization; interfere with the operation of the Service; use the Service to launder funds or otherwise engage in fraudulent activity; or resell, scrape, or reverse-engineer the Service except as permitted by law.

The Gifthycards name, logo, software, and content (excluding the gift cards and brand names sold through the Service) are our property or the property of our licensors and are protected by applicable laws. You may not copy, modify, distribute, or create derivative works from them without our prior written consent.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that gift-card codes will be accepted by any issuer. To the extent permitted by law, any implied warranties are excluded.

To the maximum extent permitted by law, we and our directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, crypto market volatility, or any transaction conducted through the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in connection with the transaction giving rise to the claim.

You agree to indemnify and hold harmless Gifthycards and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

The Service may reference or integrate third-party services, such as payment processors and gift-card issuers. We do not control and are not responsible for such services. Your use of any third-party service is subject to that provider's own terms and privacy policy.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or if required by law. You may stop using the Service and close your account at any time by contacting us. Provisions of these Terms that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitation of liability, and indemnification.

These Terms are governed by the laws of the jurisdiction in which the operator of Gifthycards is established, without regard to its conflict-of-law rules. Where the consumer-protection law of your country of residence grants you rights that cannot be waived by agreement, those rights prevail over any conflicting term.

We encourage you to contact us first so that we can try to resolve any dispute informally. If a dispute cannot be resolved, you agree to attempt mediation in good faith before resorting to courts, and any legal action shall be brought in the courts of the operator's jurisdiction, subject to the mandatory consumer protections described above.
